E. Action Items:
1. Request for approval of Cooperative Agreement Construction Modification #4 North Ogden Divide - adding $200,000.00 of funding to project - Contract C2004-120
Curtis Christensen, County Engineer, stated that this change order was to repair some areas, which included extensive excavations. In response to Chair Cain's question as to how this work would be paid for Mr. Christensen stated that it was available in the funding package.
Commissioner Burton moved to approve Contract C2004-120, Cooperative Agreement Construction Modification #4 North Ogden Divide adding $200,000.00 of funding to the project; Chair Cain seconded, both voting aye.
2. Request for consideration and approval of Construction Contract Change Order #5 - North Ogden Divide Project, with COP Construction - Contract C2004-121
Curtis Christensen, County Engineer, stated that the county had been lobbying for the last year and a half to get more funds for the project and received an additional $200,000. This money will be used to prepare a portion of Chicken Creek for a future project. The county's match portion is 7% or $14,000, which exists in the budget. This project will need to be rebid to move the material to that site but Mr. Christensen had hoped to be able to do this as part of the existing contract. Commissioner Burton said that the federal government had certain guidelines but it did not allow the most efficient use the funds.
Commissioner Burton moved to approve Contract C2004-121, Construction Contract Change Order #5 - North Ogden Divide Project with COP Construction; Chair Cain seconded, both voting aye.
3. Confirmation/Ratification of action taken on public hearing in the October 12, 2004 meeting: Request to consider Zoning Petition ZP #08-2004 to amend the Zoning Ordinance by changing language in Chapter 23 Section 29, Large Accessory Buildings - Ordinance 2004-19
Kevin Hamilton, County Planning Department, outlined the changes to this ordinance: accessory buildings shall be located to the side or rear of the dwelling with the exception that one such building which is subordinate to the dwelling in area and height may be located in front of the dwelling provided that it is located no less than 100 ft. from any public right-of-way or private right-of-way providing frontage for lots in an approved subdivision; that it conforms to the dwelling in architectural style and materials; that it is located no less than 25 ft. from a side property line and 100 ft. from a dwelling on an adjacent parcel. With the exception noted above, accessory buildings larger than 1,000 sq. ft. in area meeting zoning requirements shall be located to the rear of the dwelling unit, have a side yard of at least 10 ft., maximum height of 25 ft. and shall be located at least 6 ft. from rear of a dwelling in the Residential Estate Zones and at least 10 ft. from rear of a dwelling in the Agricultural Zones. Accessory buildings that exceed the dwelling area by more than twice now require approval by the Planning Commission as a conditional use.
Commissioner Burton moved to adopt Ordinance 2004-19 to amend the Zoning Ordinance by changing language in Chapter 23 Section 29, Large Accessory Buildings; Chair Cain seconded.

4. Request for consideration and approval of Interconnection Agreement between Weber County and Pacific Corp - Contract C2004-122
See related items E.5 and E.6 below. The County Attorney's Office will add language to Article 8, the Indemnification/Liability section of this agreement. Gary Laird, Operations Department Director, noted that the county had approved a Power Purchase Agreement with PacifiCorp for the landfill gas project. This is an additional agreement that allows the connection of the county's landfill generator to PacifiCorp's electrical network.
Commissioner Burton moved to approve Contract C2004-122, Interconnection Agreement between Weber County and PacifiCorp, subject to final changes by legal counsel regarding Article 8 of the contract; Chair Cain seconded, both voting aye.
5. Request for consideration & approval of Interconnection Facilities Construction Agreement - Contract C2004-123
See related items E.4 and E.6. Gary Laird, Operations Department Director, stated that this contract allowed the installation of PacifiCorp's equipment to connect to their electrical grid in item E. 4. The cost will be $43,698 to do the construction.
Commissioner Burton moved to approve Contract C2004-123, Interconnection Facilities Construction Agreement, subject to final changes by legal counsel regarding Article VI of the contract relating to liability; Chair Cain seconded, both voting aye.
6. Request for approval of Change Order #1 between Weber County &Blue Sky Energy on Methane Electrical Generation Contract
See item E.7. below.
7. Request for consideration and approval of Change Order #2 between Weber County and Blue Sky Energy on the Methane Electrical Generation Contract - Contract C2004-124
See related items E.4 and E.5. Gary Laird, Operations Department Director, stated that Change Order #2 showed the costs of the projects and canceled Change Order #1. Change Order #1,which was to be for $71,000 for burying the power line, was incorporated into Change Order #2 and the price was reduced by $4,000. The total change to the contract is $27,379, however, the county will pay $43,698 for interconnection construction directly to Utah Power which will increase the total to $71,077. Chair Cain asked how this amount would be paid and Mr. Laird replied that it would come from interest earnings, contingencies, and landfill closure funds. It had been anticipated having about $130,000 in the original budget for interconnection, however, with these contracts the budget is over that amount. Ogden City requested that the power lines be buried, which added another $67,239 to the cost. Weber County's cost for the electrical interconnection construction is $90,140. This amount, added to the $43,698 for the Interconnection Facilities Construction Agreement with Utah Power, would have been close to the original $130,000 estimate, but now there is the additional $67,239 for a total of $201,077.
Commissioner Burton moved to approve Contract C2004-124, Change Order #2 between Weber County and Blue Sky Energy on the Methane Electrical Generation Contract; Chair Cain seconded, both voting aye.
