MINUTESOF THE BOARD OF COMMISSIONERS OF WEBER COUNTY
Tuesday, June 15, 2004 - 10:00 a.m.
Commission Chambers, Weber Center, Ogden, Utah
Each Commission meeting is recorded on CD or audio tape, which is available to the public through the County Clerk's Office.
In accordance with the requirements of Utah Code Annotated Section 52-4-7(1)(d), the County Clerk records in the minutes the names of all citizens who appear and speak at a County Commission meeting and the substance "in brief" of their comments. Such statements may include opinion or purported facts. The County does not verify the accuracy or truth of any statement but includes it as part of the record pursuant to state law.
Commissioners Present: Commissioner Camille T. Cain, Chair, Commissioner Kenneth A. Bischoff and Commissioner Glen H. Burton.

D. Consent Items:
1. Purchase Orders in the amount of $46,839.19
2. Warrants #189138-189410 in the amount of $2,484,664.87
3. Minutes of Regular Commission Meeting held on June 8, 2004
4. Request by the Operations Department to surplus property described as LSN 08-278-0005
5. Request to set date of July 6, 2004 for a public hearing to re-zone the Weber County Road Shops at 4753 East 2650 North from Agricultural AV-3 to Manufacturing MV-1
6. Request to set date of July 6, 2004 for a public hearing to amend Chapter 22-D, Planned Residential Unit Development
Commissioner Bischoff moved to approve the consent items, less the minutes; Commissioner Burton seconded, all voting aye.
E. Action Items:
1. Request to ratify tax sale extensions
Margarit Nersisian, Clerk/Auditor's Office, stated there were 15 tax sale extensions and these would need to be satisfied by the end of November 2004.
Commissioner Bischoff moved to ratify the tax sale extensions; Commissioner Burton seconded, all voting aye.
2. Request to ratify 2004 Tax Sale list
Margarit Nersisian, Clerk/Auditor's Office, presented 38 properties for ratification. She stated that initially there had been over 400 properties on the tax sale list. The final number of properties taken to the tax sale was 46–44 were sold and 2 were struck off to the county. There were 8 properties held from ratification for further research by the County Attorney's Office.
Commissioner Bischoff moved to ratify the 2004 tax sale list; Commissioner Burton seconded, all voting aye.
3. Contract by/between Weber County & the Weber-Morgan Health Department to lease a vehicle to the Health Department for use in conjunction with a bio-terrorism grant - Contract C2004-73
Richard Badger, County Operations, stated that the Weber-Morgan Health Department received a bio-terrorism grant and they could not own the vehicle used in connection with this grant. The county will lease a vehicle to them for $367/month.
Commissioner Burton moved to approve Contract C2004-73 by and between Weber County and the Weber-Morgan Health Department to lease a vehicle to the Health Department for use in conjunction with a bio-terrorism grant; Commissioner Bischoff seconded, all voting aye.
4. Amendment #5 to Contract #961524 between the State of Utah/Second District Juvenile Court for mental health evaluations

5. Amendment #2 to Contract #030563 between the State of Utah/Second District Juvenile Court for the State Supervision Program
This contract and the above one (E.4.) were between the State and Weber Human Services (WHS) and would be forwarded to the WHS.
6. Amendment to budget amount for CDBG park campsites ADA improvement projects - Contract C2004-74
Dennis Richardson, County Engineering, stated that this contract had been originally executed with a budget amount of $174,622, however, there had been less money available then the State had believed. WACOG re-allocated funds and made this a multi-year project. This amendment revises the budget to $80,993 for the first year, with the remaining funds to be allocated to the county in 2005.
Commissioner Burton moved to approve Contract C2004-74, amendment to budget amount for CDBG park campsites ADA improvement projects; Commissioner Bischoff seconded, all voting aye.
7. Request for final subdivision approval of Mountain View Estates Phase 8 (consisting of 2 lots), including a $7,815.50 financial guarantee for improvements
Kevin Hamilton, County Planning Department, stated that this was an ongoing subdivision consisting of legal, non-conforming lots. The Planning Commission had recommended approval.
Commissioner Bischoff moved to grant final subdivision approval of Mountain View Estates Phase 8 (consisting of two lots), including a financial guarantee in the amount of $7,815.50 for improvements; Commissioner Burton seconded, all voting aye.
8. Request for final subdivision approval of Olivia Subdivision, 2 lots at 1948 South 4300 West, & acceptance of a $11,216 financial guarantee for subdivision improvements
Kelly Grier, County Planning Department, stated this was a 2-lot subdivision with curb, gutter and sidewalk along 4300 West. This property will be connected to sewer. The Township Planning Commission had unanimously recommended approval of this item.
Commissioner Bischoff moved to grant final subdivision approval of Olivia Subdivision, 2 lots, located at 1948 South 4300 West, and to accept a financial guarantee of $11,216 for subdivision improvements; Commissioner Burton seconded, all voting aye.
