Commissioners Present: Chair Glen H. Burton and Commissioner Kenneth A. Bischoff. Commissioner Camille T. Cain was excused.
Others Present: Linda G. Lunceford, County Clerk/Auditor, David C. Wilson, Deputy County Attorney. Fátima Blackford, Administrative Assistant, Clerk/Auditor's Office, took minutes.

D. Consent Items
1. Purchase Orders in the amount of $568,491.57.

5. Refund of taxes/age based fee collected in prior year on a motor vehicle - military exempt.

1. Appointment of Member to Fill Unexpired Term on the Roy Water Conservancy District Board
Roy Watts, General Manager, Roy Water Conservancy District Board, indicated that a member had
resigned and the trustees had submitted the name of Jay Cottle to fulfill that unexpired term, to become
effective May 7.
- Commissioner Bischoff moved to appoint Jay Cottle to the Roy Water Conservancy District Board to fill an unexpired term; Chair Burton seconded, both voting aye.
2. 2002 Tax Sale Extension Requests Regarding:
a. Josefina/Alejandro Quevedo, LSN 01-042-0034
b. José Campos, LSN 04-058-0061
c. Brandy & Steven Seat, LSN 11-018-0042

Margarit Nersisian, Clerk Auditor's Office, gave an overview of each application, including the total delinquency and payment schedule. She recommended approval of items "a" through "e" and to deny "f" (Larry Prantil) because the petitioner still has not complied by submitting documents to satisfy the ownership question as per the time frame he had been given.
- Commissioner Bischoff moved to accept the recommendations of Margarit Nersisian regarding the 2002 tax sale extension requests, accepting the extension requests for items "a" through "e" and to deny acceptance of item "f' for Larry Prantil; Chair Burton seconded, both voting aye.
3. Request to Waive 1999 Interest Regarding John L. Cooney III, LSN 16-176-0003
Margarit Nersisian, Clerk Auditor's Office, explained that Mr. Cooney had come to the Treasurer's
Office and paid his property taxes. At that time he had asked how much he owed and his letter
indicated he had been told the wrong amount due. Ms. Nersisian recommended not waiving the
interest. She said she could not find any reason why the wrong amount would have been given.
- Commissioner Bischoff moved to deny the request by John L. Cooney III for waiver of 1999 interest, land serial number 16-176-0003; Chair Burton seconded, both voting aye.
4. Request to Waive Penalty and/or Interest on "Dead Parcels" Regarding:
a. Gary & Judith Doud, LSN 19-014-0059.
b. O'neal Metals, LSN 15-159-0001
c. Mark Dalebout, LSN 14-012-0023
Margarit Nersisian, Clerk Auditor's Office, stated that these three items are similar. The problem occurred when the owners combined property into one parcel number. Currently in the county, when property is combined into one parcel number, the dead parcel number's property taxes are not added to the new parcel number and the property owner is not aware this is occurring and that he is delinquent because once a parcel number no longer exists or is "dead," no tax notices are generated. The county is trying to develop its system to avoid these problems in the future. Commissioner Bischoff asked how the county had handled this type of issue in the past and Ms. Nersisian stated that previously the interest and penalty has been waived.
- Commissioner Bischoff moved to waive penalty and interest on "dead parcels" regarding Gary /Judith Doud, LSN 19-014-0059; O'neal Metals, LSN 15-159-0001; Mark Dalebout, LSN 14-012-0023. Chair Burton seconded, both voting aye.
5. Weber County Tax Review Committee Recommendation Regarding LSN 18-056-0026
Margarit Nersisian, Clerk Auditor's Office, stated that this item was the same situation as item E 4
above. The petitioner has paid the taxes and is requesting to have $427.79 interest and penalties
waived.
- Commissioner Bischoff moved to approve the Weber County Tax Review Committee's recommendation regarding land serial number 18-056-0026; Chair Burton seconded, both voting aye.
6. Weber County Tax Review Committee Recommendation Regarding LSN 07-339-0008
This item was held.
7. Consideration of Contract Modification for North Ogden Divide for Final Design - Contract
C2002-52
This item relates to the North Ogden Divide Road shoulder widening and safety project. Curtis
Christensen, County Engineer, explained that there had been some obstacles during the environmental
process as well as historical issues and Native American issues which delayed the process until about
one week ago. He presented a modification to the contract with Washington Infrastructure, which will
allow them to complete the final design for the project. Mr. Christensen stated that there had been a
timeline associated with this project, which was attached to the documents before the commissioners,
however, that negotiations had taken place since the timeline had been drawn up and that the project
would be moved up about three weeks. Mr. Christensen asked that the contract be approved subject
to the county receiving the modified timeline which he anticipates will be by this Thursday or Friday.
- Commissioner Bischoff moved to approve Contract C2002-52, Contract Modification for the North Ogden Divide Road Project for final design, subject to the county receiving the modified timeline; Chair Burton seconded, both voting aye.
8. Interim Health Department Services Director Agreement By and Among Weber County, the
Weber/Morgan Health Department, and Craig Heninger - Contract C2002-53
David Wilson, Deputy County Attorney, explained that the Health Department Director had terminated
his employment recently and that he understood a national search was underway for replacement. Mr.
Heninger has filled the position as an interim director in the past and was asked by the Health Board
to do so again, and it was prudent to draw up an agreement for the employment and benefits
arrangement. Mr. Wilson had suggested to Mr. Heninger that this agreement be approved both by the
county (since it provides the benefits administration) and by the Weber/Morgan Health Department
(which provides the funding). The benefits, other than the salary increase, offered by the Health Board
to Mr. Heninger are the same as an early retirement, which Mr. Heninger will soon be eligible for. Mr.
Heninger stated that the agreement was satisfactory to him.
- Commissioner Bischoff moved to approve Contract C2002-53, Interim Health Department Services Director Agreement by and among Weber County, the Weber/Morgan Health Department, and Craig Heninger, subject to final approval by the Weber/Morgan Health Department; Chair Burton seconded, both voting aye.
9. Request by Ogden City to waive the permit fee for the Ogden Marathon
Chief A.K. Greenwood, Weber County Sheriff's Office, said that the Sheriff will provide 5-6 deputies,
3 reserve officers, automobiles, gasoline, and a mobile command post for this marathon. This was
donated last year because the permit process was not followed in a timely manner. The Sheriff feels
strongly that the Sheriff's Office should be reimbursed. Chief Greenwood stated that the Sheriff's
Office would be there providing safety regardless of fee waiver. Bryan Green, the coordinator hired
by Ogden City to coordinate the marathon for Ogden City asked the Commission to waive the permit
fee and for the commissioners to share in the vision of this 26.2 miles marathon. He outlined the
various facets of putting on a marathon and pointed out the positive economic impact for the
community. Chair Burton stated that the Commission was supportive of the overall event and pointed
out that the whole race takes place in Weber County territory. He asked what was the budget for this
event and Mr. Green replied $37,000. The commissioners indicated that Ogden Police Chief Jon
Greiner had budgeted for this marathon and Weber County had not because there had been no
communication to the county. Chair Burton pointed out that there had been problems last year related
to the marathon and this year he has heard complaints that the permit process started late and the Forest
Service had also expressed this.
Carolyn Bachman, Ogden City Special Event Coordinator, said that last year when Ogden City had its first marathon, they had a representative from the Sheriff's Office on the committee and, as coordinators of the event, assumed all the approvals were in place. This year at their first meeting, they also had a representative from the Sheriff's Office and at this time he had presented the new permit, which the organizers had no idea existed because there was no permit last year. Chair Burton said there had been a permit required, it just had not been processed in time. Chief Greenwood, stated that to this day no one had ever contacted Sheriff Slater on either event. He had not known how they had gotten a sergeant to the meetings last year and the Sheriff had questioned the sergeant and discovered that event organizers had found a sergeant in the Ogden Valley and had told him it was alright with the Sheriff and that is why he was at the meetings. Again this year organizers contacted someone from the Sheriff's Office, but once again no one talked with the Sheriff or the Chief. He pointed out the event has major impact to citizens and includes road closures, and the Sheriff needs to be involved. Chair Burton pointed out that there is a fire station and paramedics station in the Ogden Valley that are not accessible because of the Ogden Canyon road closure. In addition, he heard complaints from citizens last year because they could not go up the Ogden Canyon and get their boats to Pineview Dam. Ms. Bachman said she had asked what was the best way to notify the Sheriff, and Ogden City had said to complete the permit and that is how he would be notified. She indicated Ogden City had insured the entire event. Mr. Green said that with event coordination with law enforcement and the fire department, arrangements had been made in the interest of safety, mailers had been sent out, there had been advertising in the Standard Examiner and in the Ogden Valley News, and efforts were made to contact the Ogden Valley Business Association. Chief Greenwood stated that the amount of $938 for the permit was a very conservative total, that the Sheriff was not charging for the mobile command post and a lot of the equipment-that this was last year's figure at last year's wages. Chief Greenwood stated that the Sheriff was very willing to work with Ogden City and very desirous to make this event a success, however, they had to work with him in a timely manner to allow time to accomplish the required steps for the process.
- Commissioner Bischoff moved to waive the permit fee for the Ogden Marathon for this year with the stipulation that the organizers budget for the permit fee in the future; Chair Burton seconded, both voting aye.
