MINUTES
OF THE BOARD OF COMMISSIONERS OF WEBER COUNTY
Tuesday, October 21, 2003 - 10:00 a.m.
Commission Chambers, Weber Center, Ogden, Utah
Each Commission meeting is recorded on CD or audio tape, which is available to the public through the
County Clerk's Office.
In accordance with the requirements of Utah Code Annotated Section 52-4-7(1)(d), the County Clerk records in the minutes the names of all citizens
who appear and speak at a County Commission meeting and the substance “in brief” of their comments. Such statements may include opinion or
purported facts. The County does not verify the accuracy or truth of any statement but includes it as part of the record pursuant to state law.
Commissioners Present: Commissioner Camille T. Cain and Commissioner Glen H. Burton. Chair
Kenneth A. Bischoff was excused; Vice Chair Camille Cain conducted the meeting.
Others Present: David C. Wilson, Deputy County Attorney; Margarit Nersisian, Clerk/Auditor’s Office.

D. Recognitions, Presentations and Informational Items:
1. Presentation of the Weber County “Golden Seal of Service Award” to Fidel Silva of
the Information Technology Department
Commissioner Cain stated that Fidel Silva of the Information Technology Department had been
nominated and received the “Golden Seal of Service Award.” She read the nomination narrative and
the commissioners presented Mr. Silva with a certificate, a Seal of Service pin, an obelisk, and $50.00.
Mr. Silva said that he was honored to work for Weber County and to be a team member of the
Information Technology Department.
E. Consent Items:
1. Purchase Orders in the amount of $45,617.09.
2. Warrants #181355 - #181579 in the amount of $777,269.20.
3. Minutes of Regular Commission Meeting held on October 14, 2003.
4. Request by the Sheriff’s Office to surplus the following:
a. 1969 GMC Bus, VIN #RM70R0092834
b. 1968 Ford F-600, VIN #F60BKC64677
c. 1966 Chevy C-60, VIN #C6536S231752
5. Request by the Operations Department to surplus real property located on Edgewood Drive in South
Ogden City, LSN 06-060-0015
Items E.1 through E.4 were handled first, with discussion following for item E.5.
Commissioner Burton moved to approve consent items E.1-4; Commissioner Cain seconded, both voting
aye.
Gary Laird, County Operations Department Director, indicated the location of this sliver of property on
a plat, stating the county obtained it through a tax sale. South Ogden City is involved in acquiring
property to extend Edgewood Drive, which will connect Harrison Blvd. to Adams Avenue near Burch
Creek, and this parcel is within that proposed roadway. South Ogden City has requested that the county
deed this property to them. South Ogden has filed imminent domain proceedings on most of the other
properties. Mr. Laird referred to a letter from a neighbor, though not adjoining this road, who is in
opposition to this road.
Commissioner Burton moved to declare surplus real property located on Edgewood Drive in South Ogden
City, LSN 06-060-0015; Commissioner Cain seconded, both voting aye.
F. Action Items:
1. Contract by & between Weber County & Data Image to fund a one-time scanning
project - Contract C2003-169
Douglas Larsen, County Assessor’s Department, stated that Data Image would scan approximately
21,000 building card files. These building card files are the only copies of the property record that the
Assessor has and the scanning process will provide a backup. The Assessor’s Office appropriated the
funds for this project in the 2003 budget and the expense will be up to a maximum of $19,000. Based
on the workload, it is anticipated that the project will not be completed until sometime into the 2004
budget year, and Mr. Larsen asked for consideration to deal with this expense so that the 2003 funds are
used to complete this contractual obligation. He explained that Data Image would invoice in batches of
5,000 at the rate of 5 ½ cents per image.
Commissioner Burton moved to approve Contract C2003-169 by and between Weber County and Data
Image to fund a one-time scanning project; Commissioner Cain seconded, both voting aye.
2. Request for final subdivision approval for Stratford Estates Subdivision, consisting
of 5 lots at approximately 467 S. 4100 W. including a financial guarantee in the amount
of $17,949.81 for improvements. The petitioner is also requesting a variance from
subdivision requirements requiring curb and gutter
Kevin Hamilton, County Planning Department, showed an area map and presented the petitioner’s
request for final approval of Stratford Estates and a variance from curb and gutter requirements. The
petitioner had also requested that the sidewalk requirement be waived, however, while the county
ordinance allows waiving curb and gutter requirements, it does not allow waiving of sidewalks when a
subdivision falls within walking distance of a school of an established school district, which is the case
for this subdivision–it is not quite one mile from the school. The Planning Commission had
recommended deferral for the curb and gutter. The financial guarantee includes funds for sidewalk, in
the event this improvement would be required. Commissioner Burton asked if there was other sidewalk
in the area going to the school and Mr. Hamilton said there was not at this time, but another subdivision
about one block from the school (on 900 S.) would have sidewalk. Ryan Stratford, petitioner, said that
originally they had planned to do a 4-lot subdivision and to install sidewalk along those four lots. The
fifth lot, which has an existing home, was then added to the subdivision, and this created the need to put
sidewalk around that individual’s yard. Mr. Stratford said he had purchased the land from this individual
and was asking for sidewalk deferral just for the fifth lot because that existing homeowner had not been
aware his property would be part of the new subdivision and had not made plans to install sidewalk. Mr.
Hamilton explained that the petitioner had been required to add the fifth lot because of the size of the
lots.
Commissioner Burton moved to grant final subdivision approval for Stratford Estates Subdivision, 5 lots
at approximately 467 S. 4100 W., requiring installation of sidewalk but deferring curb and gutter, and
accepting the $17,949.81 financial guarantee; Commissioner Cain seconded, both voting aye.
3. Exclusive Right to Sell Listing Agreement & Agency Disclosure by and between Weber
County and Century 21 Gage Froerer & Associates for the listing of the old Sheriff’s
Office building located at 444 26th Street - Contract C2003-170
Gary Laird, County Operations Department, stated that since the tax-exempt bonds on this building had
been cleared, the county would like to market it listing it through a licensed real estate company. A
Request for Proposal was sent out to real estate companies. Two responses were received and after
interviewing them, Mr. Laird felt that Gage Froerer would be able to adequately market the building.
The listing price is $650,000 and the commission to be paid is 6%.
Commissioner Burton moved to approve Contract C2003-170, Exclusive Right to Sell Listing Agreement
& Agency Disclosure by and between Weber County and Century 21 Gage Froerer & Associates for the
listing of the former Sheriff’s Office building located at 444 26th Street; Commissioner Cain seconded,
both voting aye.
4. Development, Design, Construction, Operation and Maintenance Services Agreement
by and between Weber County and Blue Sky Energy Corp.
This item was held.
G. Public Hearing
Commissioner Burton moved to adjourn the public meeting and convene a public hearing; Commissioner
Cain seconded, both voting aye. 1.
2. Public hearing for an amendment to County Zoning Ordinance, Chapter 39, Ogden
Valley Lighting (Night Sky)
Kevin Hamilton, County Planning Department, stated that the Planning Commission had received
complaints about the Ogden Valley night lighting still being too bright. Mr. Hamilton said that Kelly
Grier from his department had done some research and found that most of these types of ordinances from
other entities required shielding at 100 watts instead of at 150 watts as stated in Weber County’s
ordinance. The new ordinance will require shielding for incandescent light bulbs over 100 watts instead
of 150. Language was also added to this ordinance to allow for the illumination of the American flag.
Mr. Hamilton said that the three Township Planning Commissions with jurisdiction in the Ogden Valley
had unanimously recommended approval of this item. Commissioner Cain invited public comments and
none were offered.
3. Commissioner Burton moved to adjourn the public hearing and reconvene the public meeting;
Commissioner Cain seconded, both voting aye.
4. Action on public hearing - Amendment to Ogden Valley Lighting - Ordinance 2003-18
Commissioner Burton moved to adopt Ordinance 2003-18, an ordinance amending the Weber County
Zoning Ordinance, Chapter 39, Ogden Valley Lighting (Night Sky), to permit unshielding lighting of less
than 100 Watts and to provide for lighting of the American flag; Commissioner Cain seconded.
