Commissioners Present: Chair Kenneth A. Bischoff and Commissioner Camille T. Cain. Commissioner Glen H. Burton was excused.
Others Present: David C. Wilson, Deputy County Attorney, Margarit Nersisian, Clerk/Auditor's Office. Fatima Blackford, Administrative Assistant, Clerk/Auditor's Office, took minutes.

- Request for Consideration of Tax Relief Applications:

a. Dennis Bowcutt for years 1997-2000, LSN 12-109-0003
b. Ruby Murakami for 2002, LSN 15-037-0012
a. Margarit Nersisian, Clerk/Auditor's Office, stated that Mr. Bowcutt's item had gone before the Tax Review Committee, which recommended denial to grant retroactive tax relief for the years 1997, 1998, 1999, and 2000. Mr. Bowcutt had received tax relief in 2001 and 2002. He had indicated to Ms. Nersisian he had not known about this program in 1997 when be became disabled and was now requesting tax relief for 1997 through 2000. Statute allows granting relief only for the current year but Mr. Bowcutt wished for this item to be heard by the County Commission because he was having a difficult time making the payments. Chair Bischoff asked if Mr. Bowcutt was present today and if the two payment options had been discussed with him. He was not present and Ms. Nersisian had not discussed the options with him. Commissioner Cain asked that Ms. Nersisian work with Mr. Bowcutt in hopes that he would enter into a payment plan, but if he could not, that a tax deferral plan be discussed. Ms. Nersisian said that his property was delinquent going back to 1997.
Commissioner Cain moved to deny the request for tax relief for Dennis Bowcutt, LSN 12-109-0003, for 1997, 1998, 1999 and 2000 and requested that Ms. Nersisian work with Mr. Bowcutt for a financial arrangement that would suit his situation; Chair Bischoff seconded, both voting aye.
b. Ms. Nersisian said that Ms. Murakami's son's statement indicated they had missed the deadline because the taxpayer, who is a very elderly lady, had been very ill during the year. Ms. Nersisian's recommendation was to grant the circuit breaker tax relief.
Commissioner Cain moved to approve the request for tax relief for Ruby Murakami for the year 2002 for LSN 15-037-0012; Chair Bischoff seconded, both voting aye.
- Weber County Policy Relating to Indigent Burials - Policy 24
Marcia Owen, County Purchasing Agent, referred to Utah State Code 17-5-250 which requires counties to provide indigent burial service. Weber County has been contracting with one mortuary to provide this service in the past, however, because there has been a large increase of indigent burials in the last few years, it had been determined that it would be better to open the service up to all the mortuaries in Weber County and try to get the cost down and more in line with other counties. The policy stated that the county would participate in a burial for a maximum contribution of $250 and Ms. Owen indicated that there were mortuaries that had performed this service for other counties at this amount. She planned to provide each mortuary with a copy of this policy and also notify hospitals and care centers for elderly people to make them aware the mortuaries can be contacted for these services.
Commissioner Cain moved to approve Weber County Policy No. 24 relating to indigent burials; Chair Bischoff seconded, both voting aye.
- Lease Purchase Agreement by and Between South Ogden City Police Department and the Weber
County Sheriff's Office for Portable Truck Scales - Contract C2003-7
Chris Zimmerman, Chief Deputy, County Sheriff's Office, stated that South Ogden City Police Department had a set of truck scales used to weigh truck for State compliance that they no longer needed. The Sheriff's Department has need of these scales for its traffic division and are leasing them for $1,000 t the county. Ned Malan of North Ogden stated he had been a licensed contractor for 53 years and expressed his concern that these scales were used by law enforcement for gestapo type activity. He said the officers were laying in wait for the truckers. He voiced his opposition to these types of scales stating that people needed freedom to work and to live. Mr. Malan said that he could have brought 100+ truckers to this meeting who were all in opposition to this item if he had known about this earlier. It was pointed out that the State sets trucks' weight limits. Mr. Zimmerman explained that if the Sheriff's Deputies feel that a truck is overweight the truckers are asked to weigh them on these portable scales. The Sheriff's Office and the Commission are open to comments if people feel there are problems. Chair Bischoff thanked Mr. Malan for his comments and said this item was to provide the Sheriff's Office with the tools they need to comply with the law.
Commissioner Cain moved to approve Contract C2003-7, Lease Purchase Agreement by and between the South Ogden City Police Department and the Weber County Sheriff's Office for portable truck scales; Chair Bischoff seconded, both voting aye.
- Retirement Incentive Agreement by and Between William Randy Kelly & Weber County -
Contract C2003-8
Douglas Larsen, County Assessor's Office, stated that Mr. Kelly had opted to participate in the retirement window that the Commission has offered to county employees who have participated in the State non-contributory retirement plan and who will have 25 years of qualified retirement service on or before March 31, 2003. He said that this agreement had been reviewed by the appropriate parties, including the County Attorney's Office, Human Resources, and budget review. Mr. Larsen stated that Mr. Kelly had provided exceptional service to the county and the commissioners echoed his statements.
Commissioner Cain moved to approve Contract C2003-8, Retirement Incentive Agreement by and between William Randy Kelly and Weber County; Chair Bischoff seconded, both voting aye.
- Interlocal Cooperation Agreement for Paramedic Services by and Between Weber County and
Ogden City - Resolution 1-2003, Contract C2003-9
David Wilson, Deputy County Attorney, stated that this agreement had come before the Commission recently, however, changes had been requested and some discussion had been needed regarding who would cover the insurance for vehicles and equipment when in the control of Ogden City. Ownership will be transferred to the City during the useful life of those vehicles and the City will cover the insurance. When the term is up, the City will return them. The funds for this item come from the Paramedic Fund and are to flow back to this fund.
Commissioner Cain moved to adopt Resolution 1-2003 approving Contract C2003-9 , Interlocal Cooperation Agreement for Paramedic Services by and between Weber County and Ogden City; Chair Bischoff seconded.

- Agreement for Transfer of Storm Sewer Facilities with Uintah Highlands Water and Sewer
Improvement District - Contract C2003-10
Resolution Approving Interlocal Agreement with Uintah Highlands Water and Sewer Improvement District Governing Storm Sewer Management & Service in the Unincorporated Areas of County (Eastwood Area) Within Boundaries of Uintah Highlands Water and Sewer Improvement District - Resolution 2-2003, Contract C2003-11
Gary Laird, County Operations Director, stated that some time ago (9/24/02) Uintah Highlands Water & Sewer Improvement District had come before the County Commission requesting resolution to issues relating to storm water. These issues were created in the 1980's when there were severe rain storms and flooding in that area. The District had been asked by the county to obtain a bond and create financing for an outfall line. He said that split management of a unified system resulted. The first agreement is to transfer all the infrastructure that was owned by the District to the county so that the county can manage it as one system. This includes transfers of easements that the District had to acquire in order to put that line in, and also a detention basin at the bottom of the slope. D. Brent Rose, attorney for the district, had made the presentation on 9/24/02. He expressed appreciation to the county for all its cooperation related to this issue and stated that the Interlocal Agreement sets forth the relationship between the parties with regard to storm water management and service and confirms that the county will assume full responsibility within the unincorporated areas lying within the District, including ownership, operation, maintenance, repair, and replacement of the outfall line. The county and the District indemnify each other of problems that occurred prior to and after the transfer.
Commissioner Cain moved to approve Contract C2003-10, Agreement for Transfer of Storm Sewer Facilities with Uintah Highlands Water and Sewer Improvement District, and to adopt Resolution 2- 2003 approving Contract C2003-11, an Interlocal Cooperation Agreement by and between Uintah Highlands Water and Sewer Improvement District and Weber County governing storm sewer management and service in the unincorporated areas of the county within the boundaries of the Uintah Highlands Improvement District; Chair Bischoff seconded.
